- Article 1(Terms and Conditions)
- 1. These Terms of Use shall apply to all relationships between the customer and the Company when using the regular recharging service for electric vehicles provided by JIGO WATTS, Inc. using the PIYO CHARGE application for smartphones.
- 2.These Terms of Use define the conditions of use of this service. Customers shall agree to these Terms of Use and become PIYO CHARGE members by completing the prescribed membership registration to use the service.
- Article 2 (Registration)
- 1. in order to use the service, members must agree to the terms of use and register their e-mail address, phone number, credit card information, and any other information specified by the company on the application.
- 2. In the event of any change in such information, the member shall immediately follow the procedures specified by the Service. The Company shall not be liable for any disadvantage to the member due to the member's failure to immediately notify the Company of such changes.
- Article 3 (How to use the Service)
- 1. Members can use the Service when they are authenticated by communicating with a charger designated by the Company and the Application.
- 2. Locations of chargers where the Service is available will be posted on the App. The App will display information on the full capacity of the Company's chargers.
- 3. This application displays information on the availability of the Company's chargers. However, please note that our chargers may not be available due to parked vehicles that are not using the chargers.
- Article 4 (Usage Fees)
- 1. The usage fee for this service is determined for each charger location and is displayed on the application. The recharge fee will be paid by the registered credit card.
- 2. All communication fees related to the use of the service shall be borne by the member.
- 3. Please note that the recharging fee is subject to change without notice.
- 4. Parking fees at the location where the charger is installed are subject to separate settlement in accordance with the terms and conditions of each parking lot.
- Article 5 (Settlement)
- The Member shall pay for the Service using the registered credit card.
- Article 6 (Change of Service Content, Termination)
- The Company reserves the right to change the contents of the service or terminate all or part of the service without prior notice or announcement to members. The Company shall not be liable for any damages or costs incurred by members in the event of the preceding paragraph.
- Article 7 (Notification Method)
- When notifying users of the temporary suspension of the Service or other notifications to users, the Company shall post such notifications in the Application or by any other method that the Company deems appropriate.
- Article 8 (Handling of Information)
- The Company shall appropriately handle the information specified in the following paragraph, including personal information of members obtained, used, and managed in connection with the Service, in accordance with the Company's "Privacy Policy. The Company's Privacy Policy may be revised at any time at the Company's discretion.
- Article 9 (Map Information)
- The Company uses GoogleMap, a free map service provided by Google, Inc. as map information used for this service. When using this service, you are deemed to have agreed to the following GoogleMap Terms of Use at the same time.

- Article 10 (Non-warranty of Integrity, etc. of Information Provided)
- The Company does not guarantee the completeness, usefulness, accuracy, immediacy, etc. of the map information, location information of the charger and surrounding facilities, information indicating that the charger is in use, etc. provided by the service, and assumes no responsibility for any damages incurred by members in connection with the content of the information provided.
- Article 11 (Disclaimer Regarding GPS Acquisition Accuracy)
- 1. Location information used in this service refers to latitude and longitude information and base station information obtained by the GPS function installed in the smartphone.
- 2. GPS functionality in smartphones uses signals from satellites, so GPS signals may be difficult or impossible to receive inside buildings, in high-rise areas, near high-voltage lines, or near dense trees, and in these cases, positioning is performed using base station information only. In such cases, positioning is performed using only information from the base station.
- 3. In addition, it may not be possible to obtain accurate base station information due to the installation conditions of the base station or the radio wave conditions of the smartphone. In such cases, there may be a large error between the location information and the actual location, or the location information may not be obtained, but the Company shall not be liable for any damage incurred by the member as a result.
- Article 12 (Prohibited Matters)
- Members shall not engage in any of the following acts in connection with the use of the Service
- [1] Any act that infringes, or may infringe, intellectual property rights or other rights, including copyrights and trademarks of the Company or any third party.
- [2] Falsifying or deleting the contents of the Service or information that may be used.
- [3] Inducing a third party to use the Service in violation of these Terms of Use.
- [4] Actions that violate laws and regulations or public order and morals, or that cause disadvantage to the Company or a third party.
- [5] Discriminating or defaming others, or defaming their honor or credit.
- [6] Any activity that leads or may lead to fraud or other crimes.
- [7] Use of the Service by impersonating a third party.
- [8] Transmitting or posting harmful computer programs such as viruses.
- [9] Sending advertisement, promotion, or solicitation e-mails to a third party without permission, or sending e-mails (harassing e-mails) that may or may make a third party feel displeased.
- [10] Any act that interferes or may interfere with the use or operation of a third party's facilities, etc. or the facilities, etc. for the Service.
- [11] Actions to establish a link in a manner or for a purpose that encourages such actions, knowing that such actions fall under any of the preceding items.
- [12] In addition to the above, acts that are offensive to the Terms of Service or public order and morals, acts that obstruct the operation of this service, acts that damage the Company's credibility or cause damage to the Company's property, acts that cause disadvantage to a third party or the Company, and any other acts that the Company deems inappropriate.
- [13] Acts that cause loss or damage to the charger
- [14] Any and all acts that interfere or may interfere with the use of the charger by other parties (excluding, however, the act of using the charger in accordance with these Terms of Use).
- Article 13 (Compensation for Damages)
- 1. a member shall indemnify the Company or a third party for any damage caused by the member's use of the service.
- 2. a member shall indemnify the Company or a third party for any damage caused by a breach of the Terms of Use or by any act stipulated in the preceding article.
- 3. The Company shall not be liable for any loss, damage, or expense incurred by the member as a result of the preceding paragraph, nor shall it be liable for any consequential damages or lost profits.
- Article 14 (Disclaimer)
- 1. the Company shall not be liable for any loss or damage incurred by a member as a result of any of the following, except in cases of intentional or negligent conduct on the part of the Company. In addition, the Company shall not be liable for any damages, consequential damages and lost profits caused by special circumstances.
- [1] When the Service is not available due to maintenance of the charger and problems caused by the charger.
- [2] When damage is caused by an accident resulting from the use of the charger.
- [3] When the use of the recharge service is delayed or disabled due to a communication failure, etc.
- [4] When a member's personal information is leaked.
- [5] When the Service is not available due to circumstances at the charging spot.
- [6] When a member's smartphone or this application is misused.
- [7] When this service is unavailable due to force majeure such as natural disasters.
- 2. you agree to use the Service with the full understanding that the rechargeable capacity of storage batteries differs depending on the remaining capacity of the EV/PHEV storage batteries, environmental temperature (temperature, etc.), charger output and other specification conditions, and that we assume no responsibility whatsoever for the actual recharge capacity of the storage batteries resulting from the use of the Service.
- Article 15 (Revision of Terms of Use)
- The Company may revise these Terms of Use at its discretion. In such case, the Company shall give notice of such revisions within a reasonable period of time by posting the revised contents in the Application or by any other method the Company deems appropriate.
- Article 16 (Change of Status of the Company)
- The Company may, at its discretion, transfer the Company's contractual status, rights and obligations with respect to the Service between the Company and the Member to a third party (including corporate separation and business transfer). Members shall accept this in advance and shall not raise any objections.
- Article 17 (Governing Law)
- These Terms of Use shall be governed by and construed in accordance with the laws of Japan.
- Article 18 (Jurisdiction)
- Any and all disputes between the Company and Members arising in connection with the Terms of Service shall be subject to the exclusive jurisdiction of the Tokyo District Court.
